Privacy Policy

This policy explains how Frederik Magle Publishing ApS handles personal information in connection with the main magle.dk website, our sheet music webshop and Frederik Magle’s newsletter.

It does not cover the separate blog and music forum.

1. Who is responsible for your information?

The data controller for the processing described in this policy is:

Frederik Magle Publishing ApS
CVR: 45901165
Karlebovej 70
3400 Hillerød
Denmark

Email: [email protected]

You can contact us with questions about this policy or to exercise your data protection rights.

2. Visiting the website

Website operation and security

Providing the website involves processing technical information such as your IP address, browser information, requested pages and the time of your visit. This information supports the delivery of website content, troubleshooting and protection against misuse.

The website is hosted by DanDomain. Cloudflare is also used in connection with website delivery and security.

Where processing is necessary for these purposes, the legal basis is our legitimate interest in operating and protecting the website under Article 6(1)(f) of the GDPR.

Cookies, statistics and advertising

The website and webshop use cookies and similar technologies. Some support essential functions, such as the shopping cart, login and recording cookie choices. Others are associated with statistics and advertising.

The services integrated into the website or webshop include:

  • Google Analytics, for information about website visits and use.
  • Google Ads, for advertising and measuring responses to advertising.
  • Meta/Facebook, for advertising, audience matching and measurement.
  • Jetpack/Automattic, for website and webshop statistics.

Depending on the service and interaction, these technologies can process information about pages viewed, links followed, shopping activity, referral sources, device and browser information, IP addresses and online identifiers. Advertising providers may associate this information with information they already hold about you.

Consent is required for non-essential cookies and other tracking where applicable under data protection and cookie rules. Where processing is based on consent, the legal basis is Article 6(1)(a) of the GDPR. Reading this policy or simply visiting the website does not itself constitute consent.

The webshop provides a “Cookie settings” panel. You can also use your browser’s controls to block or remove cookies, although blocking essential cookies may affect shopping and account functions.

Audio, video and external links

Some pages contain embedded media from services such as YouTube and SoundCloud. Loading an embedded player can involve communication with the provider, including transmission of your IP address and browser information. Further processing may take place when you use the player.

External links to streaming services, social networks and other websites take you to services whose processing is described in their own privacy policies.

3. Buying sheet music and using a customer account

We process the information needed to fulfil your order, provide access to your purchases and handle order-related enquiries. This includes relevant contact and billing information, the products purchased, order and payment references, and correspondence relating to your purchase.

If you use a customer account, information associated with that account is also used to provide account functions and access to purchased sheet music.

The legal basis for processing necessary to fulfil your order or provide the agreed service is Article 6(1)(b) of the GDPR. Information required for accounting and tax purposes is processed under Article 6(1)(c), which covers compliance with legal obligations.

Required information is identified during checkout. Without the information necessary to process an order, we cannot complete the purchase.

Payments

We use OnPay as our payment gateway and Clearhaus for card acquiring. Relevant payment and transaction information is processed by the payment providers, card networks and financial institutions involved in completing a payment.

The webshop receives information about the transaction needed to administer your order, including its payment status and references. Payment providers may also process information for their own regulatory and fraud-prevention obligations.

The conditions governing purchases and the use of our sheet music are set out separately in our Terms and Conditions.

4. Frederik Magle’s newsletter

The newsletter shares news about Frederik Magle’s music, including new works, performances, recordings and sheet music.

We use MailerLite to manage subscriptions and send newsletters. MailerLite processes subscriber information on our behalf.

Subscription information and interests

We process your email address, your name if you provide it, your selected newsletter language or languages, and information relating to your subscription and confirmation.

We also record the signup form used. For example, subscribing through a wind and brass music form associates your subscription with an interest in that repertoire. Language and interest information can be used to select recipients for relevant newsletters. You may also receive general news within the scope described when you subscribe.

Newsletter subscription is voluntary and based on your consent under Article 6(1)(a) of the GDPR.

Newsletter statistics

MailerLite’s tracking functions can record email openings and link clicks and associate them with a subscriber. Opening measurement uses a small invisible image in the email; link tracking records interactions with tracked links.

Campaigns using the webshop integration can also measure visits and purchases following an email link. These functions provide information about newsletter engagement and the effectiveness of campaigns.

Receiving newsletters and measuring individual engagement are distinct processing activities. Where consent is required for engagement tracking, that processing requires an appropriate consent in addition to the information provided in this policy.

Unsubscribing

You can unsubscribe at any time using the unsubscribe link in a newsletter or by contacting [email protected].

Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal. See the retention section below for information about records that may remain after unsubscription.

5. Contacting us

When you contact us, we process your contact details and the information you provide so that we can respond and handle your enquiry.

For enquiries concerning a purchase or proposed agreement, the legal basis is Article 6(1)(b) of the GDPR. For other enquiries, the legal basis is our legitimate interest in responding to correspondence under Article 6(1)(f).

Please only include personal information relevant to your enquiry.

6. Service providers and other recipients

Personal information is processed by relevant service providers for the purposes described above. These include hosting and security providers, payment providers, MailerLite, and the statistics, advertising and media services identified in this policy.

A provider processing information on our behalf acts as a data processor. Some providers also act as independent data controllers for particular activities, such as fulfilling their own payment-related legal obligations. Their privacy policies explain those activities.

Information may also be disclosed to public authorities where required by law, or to professional advisers where necessary in connection with a specific legal or accounting matter.

International processing

Some service providers operate internationally and may process information outside the EU/EEA.

Transfers outside the EU/EEA must have an appropriate legal basis, such as a European Commission adequacy decision or appropriate safeguards, including Standard Contractual Clauses where applicable. You can contact us for information about the arrangements relevant to your information and how to obtain a copy of applicable safeguards.

7. How long we keep your information

The retention of personal information depends on the purpose for which it is processed. Different information relating to the same person may therefore be kept for different periods.

Orders and accounting records
Invoices and other accounting records are generally retained for five years from the end of the financial year to which they relate, in accordance with Danish bookkeeping requirements.

Customer accounts and access to purchased sheet music
Information identifying your purchases and download entitlements is retained while it is needed to provide your continuing access to purchased sheet music. Closing an account does not necessarily result in the deletion of records that must be kept for accounting purposes or to resolve an outstanding dispute.

Enquiries and correspondence
The retention of correspondence depends on whether the enquiry has been resolved, whether the correspondence forms part of an ongoing customer relationship or agreement, and whether it is needed to handle a specific complaint or legal claim. An enquiry does not, by itself, justify retaining all related information indefinitely.

Newsletter subscriptions
Subscriber information is used while your subscription remains active. If you unsubscribe, it is no longer used to send you newsletters. Unsubscribing does not necessarily delete every record immediately: limited information may be retained to document your consent and withdrawal, honour your unsubscribe request, or resolve a specific complaint. These purposes do not require the continued retention of your entire subscriber profile.

Technical and statistical information
Retention depends on the function of the information, including the period covered by relevant statistics and whether technical records are needed to investigate a particular error, security incident or misuse. Cookie expiry periods and the retention of information held by service providers are separate from the retention of order and subscriber records.

Where information is no longer needed for its original purpose, any continued retention must have a separate, valid justification. You can contact [email protected] to ask about the information held about you or to request its deletion, subject to applicable legal obligations and exceptions.

8. Your rights

Depending on the circumstances, you have the right to:

  • Obtain access to your personal information and receive a copy.
  • Have inaccurate or incomplete information corrected.
  • Request deletion of your information.
  • Request restrictions on its processing.
  • Receive certain information in a portable format.
  • Object to processing based on legitimate interests.
  • Withdraw consent where processing is based on consent.

You can object at any time to processing for direct marketing, including profiling related to that marketing.

Some rights are subject to exceptions. For example, information required for accounting purposes may need to be retained even if you request deletion.

To exercise your rights, contact [email protected]. We may request information reasonably necessary to verify your identity.

You also have the right to lodge a complaint with the Danish Data Protection Agency, Datatilsynet, or another competent supervisory authority.

9. Changes to this policy

This policy may be updated to reflect changes to our services, processing activities or applicable requirements. Material changes will be brought to your attention where required.

A change to this policy does not, by itself, provide consent for a new use of your information.
